Access to justice under the CSDD Directive

Finalizing trilogue negotiations of the Corporate Sustainability Due Diligence Directive

This position paper deals with access to justice measures within the CSDD Directive. It looks at measures to improve access to justice from a rightsholders perspective.

Worldwide litigation efforts in cases of human rights abuses by corporations have demonstrated many obstacles for rightsholders. To comply with international legal standards for access to justice, Member States must ensure that the CSDDD does not contain procedural obstacles. The Institute summarizes key access to justice elements for both the design and transposition of the CSDD Directive.
